When was the real Lex replaced by an alien pod person?

Does anyone else think that Lex is acting very out of character? He's turning "good" - finding Lana and not taking revenge, not running away from the murder charges when he had the opportunity, etc.

actually i think it is in character. yes he is turning evil w/o a doubt. but there is still a trace of humanity still in him that hasn't been extinguished yet. i understand if he's sorry or regretful with lana. if he had taken the gun and shot her, that would have been out of character for him at this point in time. but that's just my thoughts.
